1. General & Acceptance of Terms
By booking, scheduling, purchasing, or utilizing any services provided by Svitlight Media ("the Company," "we," "us," or "our"), the client ("Client," "you," or "Agent") agrees to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between Svitlight Media and the Client governing all real estate photography, videography, drone operations, floor plans, virtual staging, 3D tours, and digital marketing services.

2. Copyright, Ownership & Usage Licensing
Svitlight Media retains exclusive copyright, intellectual property rights, and ownership of all media produced, including raw files, processed photographs, video recordings, aerial captures, floor plans, and digital renderings.
Upon full payment of all invoices, the Client is granted a limited, non-exclusive, non-transferable license to use the delivered media solely for marketing the specific property listing on the Multiple Listing Service (MLS), brokerage/agent websites, and digital marketing channels (including social media).
This license remains valid only for the duration of the propertyâ??s active listing under the hiring Agent. Media files may not be sold, gifted, sublicensed, or transferred to third parties (including homeowners, builders, interior designers, staging companies, architects, or successor agents) without prior written consent and payment of additional licensing fees to Svitlight Media.

3. Turnaround Time & Media Delivery
Standard photography packages and MLS video tours are typically delivered within 24-48 hours of shoot completion. For complex projects, peak seasons, extensive cinematic video editing, custom virtual staging, 3D rendering, or specialized AI enhancements, delivery may take between 24 and 48 hours. Svitlight Media will make reasonable efforts to communicate any anticipated production delays.

4. Cancellations, Rescheduling, Lockout & No-Show Policy
â?¢ Standard Notice: Cancellations or rescheduling requests must be submitted in writing at least 24 hours prior to the scheduled appointment time at no penalty.
â?¢ Late Cancellation (< 24 Hours): If a cancellation or rescheduling request is made less than 24 hours prior to the scheduled appointment, a late cancellation fee of up to $100.00 may be charged, billed to the Client, or retained from any advance payment or booking deposit.
â?¢ Lockout / Inaccessibility / No-Show: If an authorized representative of Svitlight Media (including the business owner, an employee, or an assigned contractor/videographer) arrives on-site and cannot access the property within 20 minutes of the scheduled appointment time (due to incorrect lockbox codes, missing keys, absence of homeowner/agent, lockout, or on-site cancellation), a $100.00 lockout fee plus the full travel fee may be charged and billed to the Client, or deducted from any prepaid funds or deposits.
â?¢ On-Site Delays & Waiting Time: A complimentary 15-minute grace period is provided. Any additional on-site waiting time caused by late arrivals, ongoing cleaning, staging, or moving items will be billed at $30.00 per 30-minute increment.

5. Payment Terms & Refund Policy
All invoices are due upon receipt or prior to the release of final media files. Initial previews or proofs may be delivered with a visible watermark. Final high-resolution, unwatermarked media files and download links are released immediately upon receipt of full payment via accepted payment methods (Interac e-Transfer, Credit Card, or Square).
All completed shoots, editing services, and delivered media are strictly non-refundable once on-site production has taken place.

6. Property Readiness & "As-Is" Policy
The Client is strictly responsible for ensuring the property is fully prepped, cleaned, decluttered, staged, and photo-ready prior to the arrival of Svitlight Mediaâ??s representative. Svitlight Media photographs and films properties strictly "as-is." Company representatives and contractors do not move furniture, lift heavy or personal items, handle debris, or perform cleaning duties. Svitlight Media assumes no responsibility or liability for dust, clutter, staging flaws, or unwanted personal items visible in the final media due to a lack of property preparation.

7. Revisions, Retouching & Strict 48-Hour Acceptance Window
Standard photography deliverables include natural exposure balancing, color correction, and vertical perspective alignment. Standard video production includes one complimentary round of minor revisions (such as trimming a specific brief clip or updating agent contact cards).
Strict 48-Hour Acceptance Window: All requests for corrections, revisions, or adjustments must be submitted in writing within 48 hours of media delivery. After 48 hours, all delivered media is deemed fully accepted, approved, and finalized by the Client. Any subsequent revision requests, major stylistic changes, or re-edits submitted after this 48-hour window will be treated as a new work order and billed at standard hourly editing rates.

8. Property Size & Scope Discrepancies
Service pricing and package selection are based on the accurate square footage, layout, and room configurations specified by the Client during booking. If Svitlight Mediaâ??s representative determines on-site that the property significantly exceeds the booked dimensions (e.g., undisclosed finished basements, additional suites, or square footage tier discrepancies), Svitlight Media reserves the right to adjust the final invoice to reflect the actual property size tier and applicable service rates.

9. Weather Conditions & Drone Safety (Transport Canada)
Svitlight Media reserves the right to postpone or reschedule exterior photography and drone operations in the event of adverse weather conditions (including rain, heavy snow, high wind gusts, dense fog, or extreme temperatures) to ensure personnel and equipment safety.
All drone flights are conducted in strict compliance with Transport Canada regulations. If a property is situated within controlled, restricted, or no-fly airspace, drone operations cannot be performed, and the drone portion will be credited or substituted with equivalent services.

10. Limitation of Liability & Property Safety
Svitlight Media, its owners, authorized representatives, employees, and independent contractors shall not be held liable for any accidental damages, personal injury, or property loss occurring on the premises, except in proven cases of gross negligence. Clients and property owners are solely responsible for securing pets, fragile decor, and personal valuables prior to the appointment. Svitlight Mediaâ??s maximum aggregate financial liability for any operational delay, equipment malfunction, or lost data is strictly limited to a refund of the amount paid for the affected service.

11. Governing Law
These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
